Mortimer Matz in grand larceny investigation

update June 4 The Jewish Week reports that one service Matz did provide is suggest a press conference after the DA’s office declined to pursue a pedophilia case with an Orthodox Jewish defendant. Matz’ partner in Matz, Blancato and Associates: Robert Blancato says that he never received any of the state funds and claims that Matz was essentially a figurehead who had no significant role at the firm since before 2003.

The New York Times has an article about former Nathan’s Famous promoter Mortimer Matz, whose public relations firm allegedly received more than $200,000 of NY State funds from former Brooklyn District Attorney Charles Hynes in 2012 and 2013. The money was originally acquired by confiscating the assets of people convicted of drug crimes and intended for law enforcement purposes. The payment could result in grand larceny charges for Hynes for misuse of government funds. From 2003 to 2013, Matz’ firm received a total of $1.1 from the DA’s office for “public relations and community services”. ( Gothamist | NY Daily News | NY Times)

In 2010 Matz admitted fabricating the 1916 origin story for Nathan’s Famous hot dog eating contest. In the same interview, he ironically offers the advice: “Morty Matz always tells the truth”.

Allegations about Matz in the New York City Department of Investigation’s Findings on Charles J. Hynes follow:

The KCDA [Kings County District Attorney] had in its employ from 2003 to 2013 a consultant named Mortimer Matz, who ostensibly was hired by KCDA to provide public relations and communications services to the office. It appears that from at least January 4, 2011 to November 22, 2013, Matz’s firm, Matz, Blancato Associates, submitted approximately 80 invoices to KCDA, roughly half of which directed to the attention of Dino Amoroso, who was at the relevant time the KCDA Deputy District Attorney, and roughly half of which were directed to the attention of Amy Feinstein, who at the relevant time was the KCDA Chief Assistant District Attorney. The description section of each invoice states a per diem rate of $536.40 for Public Relations and Communications Services rendered. The invoices purport to bill KCDA the amount of $2682 per week, based on five weekdays each week. Based on investigation to date, including based on information provided to DOI by the KCDA, it appears that Matz provided few if any actual public relations and communications services to the KCDA. Instead, as demonstrated by the Matz e-mails described herein, review suggests that Matz was serving primarily if not exclusively as a political consultant to Hynes personally, and that he had a major role in orchestrating Hynes’ 2013 reelection campaign.

Further, records obtained from KCDA reflect that from January 1, 20l3_ to November 26, 2013, the office typically issued on average two to three checks each month to Matz, Blancato Associates, in varying amounts, from what appears to be a
subaccount titled in consideration of purported office
consulting services. KCDA advised DOI that in calendar years 2012 and 2013, KCDA issued checks to Matz, Blancato Associates in the total amount of $219,924. For Matz’s entire 2003-2013 tenure, KCDA advised DOI that KCDA paid Matz, Blancato Associates approximately $1.1 million out of state asset forfeiture funds.

It is not clear from the articles if Matz could be subject to jail time. He might have to pay back $1M+ which he may not have on hand.
