Cookie Jarvis gives thumbs down to MLE DVD
(From BeautifulBrian.com) Cookie Jarvis is upset that IFOCE used footage of him in the MLE DVD without requesting permission:
This is the last straw IFOCE! It’s no longer a joke and neither are our feelings. If someone requests an interview with us we have to first call the IFOCE and get their permission so they can profit at our expense. If the IFOCE wants to put out a movie with us in it they feel we don’t need to be told. Is that fair? NOOOOOOO!
I think its time for us to have a spokesperson on how we are treated and the events that our portrayed with our likenesses. I believe it’s also time for us to have input in what we are shown in. Maybe it’s even time for a class action law suit against the IFOCE because we wont take it anymore. This is an outrage!

For the 1st time in your life, you are LATE in coming to the table.
You had the power to do something when you were doing well, you have NO power now.
Also, i’m quite sure you did sign something regarding your likeness. Maybe not for that specific video, but certainly in general terms.
I apologize to those I lied to (except Hardy, I had a responsibility to lie to him as commish of the ifoce) regarding Boone’s participation in Dumplings. He was there. He only ate 39 dumplings.
I lied to try to keep, what I thought was a friend, involved in Krystals & or the Spike tv thing.
He has also competed in MANY other events outside the ifoce, including several that I fed to him. I can recall a couple off the top of my head. Burgers in Myrtle Beach & wings in Chattanooga.
Others of you that i have fed contests to can relax, i’m only outing BOONE.
He actively participated in keeping me out of B&W Cookies by threatening & cajooling the guy running it. (Not Arnie) & probably lying about me as well.
He then threw a typical Boone fit when he tied Ian Hickman w/11 cookies in 5 minutes.
Happily, there wasn’t an eat off, & Boone & Hickman split the $1,000. He brought his mom, so his $500. likely didn’t cover his expenses.
Arnie is furious w/ his antics & has said “never again”. So he is truly an independant eater now.

If Boone is permitted back in, and it wouldnt surprise me one bit, other eaters should have the same rights to test the waters doing contests outside the IFOCE.

You people dont seem to get the picture. Jarvis and other old school eaters were part of IFOCE productions.and featured on INHD, Gutbusters, Big Eats, MLEaters and other ventures. Forget about what they signed. Does it state in the contract that they have the right to use his image and not give him shit in return? So dont put words in others mouths unless you damn well know what you are tallking about. Shea’s made big money on these projects and shared shit with them . They got zilch. One word sums it up GREED! Maybe the courts should demand the IRS audit shea communications , open the books and see just how much they racked in since 2001 while the devoted eaters were used as pawns to inflate Sheacommunications wallets. Oh sure they’ll tell you they made shit off Jarvis and the other guys .They can also have the books doctored or stash the loot in a swiss account. . Remember it’s the ones that cry poverty that have more or equal value in assets to a Don Trump

I have not signed a contract with IFOCE so I can not say what it says about this subject. What I can say from personal experiences is all the waivers I had to sign before I competed in any contest with IFOCE.
If you took the time to read these contracts / waivers, you will see that you are signing your rights away to any compensation to your image, likeness, voice or other to which IFOCE, the sponsor and anyone putting on the contest can use you for whatever means they want. That means for advertising, publication and yes even making movies and DVD’s to which they make money and you get nothing.
Too many people get a contract and/or waiver put in front of them and they just sign without taking time to read. That also goes to cell phone contracts, credit cards, auto loans and contests.
If Cookie, BB and whoever else is complaining about what IFOCE did with their image by making this DVD, I feel they need to grow up and admit they did not bother to take the time and read the legal contracts and waivers they signed. If they say they read them then they know they have no leg to stand on because they signed away their rights.
IFOCE is in the business to make money. I’m sure they hired teams of attorneys to look over and write out contracts and waivers that will benefit them. If you do not like what IFOCE is doing then just quit IFOCE and stop signing waivers and contracts with them.
Unless you can prove slander or libel then do not bother wasting your time about filing a lawsuit.
And to BB, if you keep saying how bad IFOCE is and they will not give you no money then why do you stay with them? Cancel your contract with them if you still have one and stop signing waivers and entering their contests. Until then you keep feeding the hand you say is doing you wrong.

The concept of this IFOCE is to distract the members or eaters from finding out how much dough the people that run this organization are pulling in . Names such as Rhonda Evans and others that argue and debate back and forth about how many lbs of food Chestnut or Pat will consume is exactly what they want..If the eaters themselves debate amongst each other, then that is even more of a plus. This type of friendly trash talk keeps everyone busy while the Shea’s go off in a corner somewhere counting the money they made off of everyone. Dont be surprised if one day there will be an admission fee to enter all contests. Let us then see how many of you loyalists come to their defense when the food at the table comes with a price . . I could fathom the higher ranked eaters paying a fee because they make it up in prize money. If lower ranked eaters that do not have a prayer of being in the money pay that fee, then it is obvious that you are sad sacks of shit with no life at all.

If the Shea’s have so much power then why was Pat Philbin and his pests able to dominate them so easily. Where was the legal power back then? When Joe Menchetti bad mouthed them on his website the best they could come up with was a secretary that worked for a legal aide dept to type up a letterhead that cost maybe $15. You call that legal power? What looks good on the outside is just that. . Some of the biggest bodybuilders are the biggest whimps.Have you ever had the balls to call out a bodybuilder or any tough guy who talks shit ? I have and you will be quite surprised how tough they really are. Some will run like a little bitch . . In addition they like to hit you with these contracts or waivers as to catch you off guard just before a big event such as wingbowl , meatballs alka seltzer or any other big show.

Theoretically we’re not getting any compensation for what we do and the contract is moot. The main guys from the World Series Of Poker sued their organization a few years ago and had a major pay day for their likeness being used. Pretty much the IFOCE waiver says that our compensation is letting us work. That obviously doesn’t count so if they were to use the likeness of an eater that hasn’t made a penny eating, he/she can have a fun legal battle and get a nice pay day.

since the shea’s pulled in roughly a quarter of a million on the dvd they should have been generous and given each participant 5 grand a piece. I think that would have been a fair offer. Maybe Joey got his already

Pete, you have a very good point. A couple of them, actually.
First, there is only minor consideration in those contracts, because it seems like the eaters are giving up a lot of rights and personal identity just to be allowed to compete. The problem is, it is already easy to get out of the contract. You just leave. Getting back in is the hard part.
Second, the poker lawsuit against WPTE (not WSOP) was for the very same issues as what everyone has been upset with IFOCE about. Not being able to play outside the WPTE, no compensation for use of pics and video. Anyone know what ever came about from that? It could set a good precident for the problems with the IFOCE.
I did notice that the video of Cookie grilling wasn’t at an IFOCE event. Where did they obtain this video from? I don’t think they are allowed the rights to use any footage of someone for use in their promotions, only their video.

The video of cookie grilling the hot dogs was a home video in his backyard that belongs to Cookie and noone else. It was used on espn as a lead in for one of the coney shows or alka seltzer u.s open In the future anyone that is dumb enough to sign that contract which gives them the right to use your face for advertising tv or any other media events should have their mommy and daddy along as co signers. .If you think entering a contest is more important to you than them making a nice profit off your name , then you are one stupid ass.

Nothing will become of this. I almost want to laugh, because as much as I respect the accomplishments of many of the legends featured in that DVD, that likely represents the last hurrah for any type of publicity they will receive in the future.
The smart ones won’t push it. The ones who do are likely breaking bread with the IFOCE for the last time. What do they have after that? Pride? Dignity? Yeah, right. Is that a violin I hear?

I will say this once and hopefully it will put and end to this topic. If anyone has something to say to me and i assume its ok for print then i will print it. Ask anyone in CE . If they have told me to keep something in confidence, i have always respected their wishes and it has never ended up on my website. Contrary to belief, my editorial is designed to make people aware of what is happening in the CE world. Sometimes its news people want to hear sometimes its not. The satire that is attached to it , is there for entertainment purposes and hopefully put a smile on someones face.. I dont get my jollies off of mocking or making someone look like a fool. Did i out this man in any way shape or form.? This DVD controversy was his initial doing on his website and not mine. I came to bat for him with some editiorial on my site and then he wants to save face and take it all back. What the hell does that tell you? You come to your own conclusions because i rest my damn case. The intelligent people in this forum will decide who is right and who is wrong.

The post that OJ removed which came from Ed Jarvis was filled with so many spelling errors he came off looking like the fool and not Brian. He practically told him to mind his own business and then proceeded to berate his eating skills. Real class act. I viewed the entire DVD and Brian was one of the few or maybe the only one that was quoted as saying Cookie is one the greats in competitive eating. I think someone is owed an apology and it sure as hell isn’t Cookie Jarvis. If i were Brian i dont think i would accept it. BTW we know you are not a BB fan so you will look to contradict this comment and find some way to side with Ed Jarvis. According to your 10/2 12:15pm post you saw nothing wrong with the post. Sometimes when you read between the lines the post does not necessarily have to be vulgar or vicious in order for the author to take it down. OJ is a great judge of character to make a call like that. He saw someone taking a beating for no reason and pulled the plug on it.

I was never against BB. I would comment when he strayed away from the point, or just didn’t make any sense, but he was the one that made it appear like there was some king of a feud between us when he misunderstood something that I posted. I think the sentence was “very sneaky segue” or something like that. Not my fault if the guy is illiterate. Others had told me that they saw no reason for his knee jerk response to me. I don’t know him personally, so I could care less.
